1. Acceptance of Terms

These Terms of Use ("Terms") govern access to and use of notyourtype.nl (the "Site"), operated by notyourtypefoundry, registered in Rotterdam, the Netherlands. By accessing or using the Site, the user agrees to be bound by these Terms. Users who do not agree to these Terms must discontinue use of the Site.

2. Scope of Use

The Site provides the following functions: browsing and purchasing font licenses, evaluating typefaces through the type tester tool, accessing articles and project documentation, and submitting inquiries regarding commissioned design work. Use of the Site is permitted solely for these purposes.

3. Prohibited Conduct

Users MAY NOT:

1. Access or extract content from the Site through automated means, including but not limited to scraping, crawling, or indexing tools, except as permitted by the Site's robots.txt file.
2. Use any visual content displayed on the Site — including but not limited to rendered typeface specimens, type tester output, screenshots, or other visual representations of the typefaces — for the training, fine-tuning, evaluation, or development of artificial intelligence, machine learning, or generative systems.
3. Reproduce, distribute, or publicly display content from the Site without prior written authorization.
4. Use the Site or its content in a manner that misrepresents its origin or ownership.
5. Use the Site in violation of applicable law.

4. Font Licensing

Purchase and use of font licenses are governed by the End User License Agreement ("EULA"). These Terms govern use of the Site itself and do not modify the EULA.

5. Type Tester

The type tester tool is provided to allow evaluation of typefaces prior to purchase. Font data accessed through the type tester remains the property of notyourtypefoundry. Extraction, capture, or reproduction of font data through the type tester is prohibited.

6. Intellectual Property

All typeface designs, visual content, and written material on the Site are protected under applicable copyright law, including the copyright protections afforded to typeface designs under Dutch and EU law. All rights not expressly granted are reserved.

7. Third-Party Links

The Site may contain links to third-party websites. notyourtypefoundry is not responsible for the content, accuracy, or practices of such third parties.

8. Disclaimer of Warranty

The Site is provided "as is" without warranties of any kind, express or implied. notyourtypefoundry does not warrant that the Site will be uninterrupted, or error-free.

9. Limitation of Liability

To the extent permitted under Dutch law, notyourtypefoundry shall not be liable for any direct, indirect, incidental, or consequential damages arising from use of, or inability to use, the Site.

10. Amendments

notyourtypefoundry reserves the right to modify these Terms at any time. Amended Terms will be published on the Site with a revised date. Continued use of the Site following publication of amendments constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Rotterdam, the Netherlands.
