1. Introduction

This End User License Agreement (“EULA”) is a legal contract between you (the “End User,” “Customer,” or “Licensee”) and notyourtypefoundry (“notyourtypefoundry”). By purchasing, downloading, installing, or using the Font Software, you agree to be bound by this agreement.

All Font Software is licensed, not sold. After purchase and download, all font licenses are non-returnable and non-refundable, except in the case of technical defects.

2. Definitions

Font Software
All files provided, including but not limited to .otf, .ttf, .woff, .woff2, and their variants.

Licensee / License Holder
The individual or organization named on the license certificate who holds the right to use the Font Software. This is the end client or end user, not necessarily the party who made the purchase.

Purchaser
The party who pays for the license. This may be the Licensee themselves, or a designer/agency acting on behalf of the Licensee.

Project
A single, clearly defined creative work or initiative with a specific scope, deliverables, and usage context. 

License Certificate / Invoice The document issued upon purchase that names the Licensee (Licence Holder/End User), project details, usage type, and permitted scope. The invoice serves as the official license certificate.

3. Scope of the License

3.1 Project-Based Licensing

Each license is valid for one specific project by one client. New projects or expanded uses (e.g., from a print poster to a social campaign) require a separate license.
The licensee must be the end client. 

Designers may purchase on behalf of clients only if the client is clearly named in the license certificate.
A license certificate is issued as proof of use rights. The licensee must retain it.

3.2 Types of Licenses

A license granted for one use case (e.g. social media) does not automatically permit other types of use (e.g. print, web, app, or video), unless specifically bundled or upgraded.

  • For printed materials like books, posters, brochures, and editorial design.

  • Web

    With a Web License you will not receive a font file (such as WOFF2/WOFF) for self-hosting. Instead, you will receive an embed code that allows the font to be loaded on your licensed domain via our hosted webfont service. A short instruction guide is provided if needed. The license applies to one project/domain only, and does not permit redistribution, file sharing, or use across multiple projects. During checkout, you will be asked to fill in the domain name.

  • Social Media

    For static or animated content published on platforms like Instagram, TikTok, or YouTube.

  • Video

    For use of the Font Software in time-based media such as film titles, motion graphics, commercials, music videos, trailers, or online video content (e.g. YouTube, Vimeo, TikTok). A separate license is required for each video project unless bundled under a branding license.

  • Visual Identity

    For broader brand elements across print, digital, and environmental design (excluding web/app/video unless separately licensed).

  • Logotype

    For creating a single logo or logomark.

  • Free To Use BUT Be Nice

    Typefaces under this license are free to use for both commercial and non-commercial purposes.

    Be Nice to Whom?

    Be Nice to People.
    You cannot use this typeface to create or distribute harmful, discriminatory, or offensive content toward any individual, group, or religion.

    Be Nice to the Designer.
    You must credit the type designer and the foundry whenever you use this typeface.

    Be Nice to the Font File.
    You cannot redistribute the font file or its source files without explicit permission from notyourtype foundry.

    By downloading, installing, or using this font, you agree to abide by these terms.

  • Branding License (available upon request)

    For comprehensive brand use across all media and platforms — including print, web, app, social, video, and packaging.
    This license is tailored to larger campaigns or long-term brand systems and is provided as a custom bundle.
    Please contact us to discuss scope, pricing, and usage details.

3.3 Trial Fonts

notyourtypefoundry does not provide trial or demo versions of its Font Software. All Font Software must be licensed prior to any form of use — including internal testing, proposals, or layout previews. Any unauthorized testing, previewing, or internal use of the Font Software without a valid license is strictly prohibited. 

4. Rights and Restrictions

4.1 Rights Granted

Upon full payment, the Licensee receives a non-exclusive, non-transferable, non-sublicensable right to use the Font Software within the licensed project and media scope. You may use the fonts within the licensed scope and convert text to outlines for static design (e.g., logos); you may not reuse the same license across multiple projects or clients, or extend usage without additional licensing.

4.2 Usage Restrictions

You MAY NOT:

  • Share, lend, or distribute the Font Software to any third party. 

  • Upload the Font Software to third-party platforms such as Canva, Framer, or any other tools that allow font files to be stored or used via a cloud-based service.

  • Embed the fonts in editable or extractable formats, including but not limited to editable PDFs, online editors, or collaborative design platforms.

  • Use the Font Software for any form of artificial intelligence (AI), machine learning (ML), or generative system development.
    This includes using the fonts to train, fine-tune, evaluate, or contribute to datasets for type synthesis, OCR, computer vision, or image generation — whether for commercial, academic, or personal use.
    We do not — and will never — grant permission to use our fonts in any AI-related context.
    Such use is considered a serious breach of this agreement and a violation of the design principles that are central to our practice, and may result in immediate termination of the license and legal action.

  • Modify, decompile, reverse-engineer, or rename the font files.

  • Sub-license, sell, or transfer the Font Software or any rights granted under this agreement to another party.

  • Use the Font Software in any way that violates applicable law, infringes on the rights of others, or exceeds the licensed scope — for example, using a Print License in an app, or a Web License in video content.

4.3 Designer Responsibility & Font File Access

In many cases, designers or studios purchase font licenses on behalf of their clients. In these situations:

  • The Licensee (the client named on the invoice) holds the license rights - the legal permission to use the Font Software in the specified project.
  • The designer or agency (the Purchaser) manages the font files - they install, operate, and maintain control of the actual files.

To ensure proper use of the Font Software—especially regarding format handling, embedding rules, and scope of use—font files should remain under the management of the designer or agency who purchased them. Font files should not be redistributed to the client unless there is specific written permission from notyourtypefoundry.

If the Licensee needs direct access to the font files (e.g., for in-house design work), please contact us to arrange this.

If other collaborators (e.g., developers, printers) require access to the font files, additional licenses or written permission must be obtained.

5. Delivery and Security

Font Software is delivered digitally via a secure, time-limited or tokenized download link.

The Licensee is responsible for ensuring that:

Font files are stored securely in accordance with the license terms.
Access is restricted to the licensed team members and within the scope of the licensed project.
Font files are not shared with external collaborators (e.g., freelancers, printers) unless such collaborators are covered by separate licenses or have received written permission from notyourtypefoundry.

6. No Resale or Intermediaries

notyourtypefoundry sells licenses directly to end users only. There are no authorized resellers. Any license purchase must be made through notyourtypefoundry. Designers and agencies procuring fonts for clients are responsible for correctly communicating the client’s identity and intended use. The contract is formed between Notyourtypefoundry and the named licensee.

7. Warranty & Liability

The Font Software is provided “as is.”
notyourtypefoundry shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Font Software.

8. Termination

Violating this EULA immediately voids the license. The Licensee must delete all copies of the Font Software and cease all usage. Notyourtypefoundry reserves the right to seek legal compensation for unauthorized use.

9. Jurisdiction

This agreement is governed by the laws of the Netherlands. Disputes shall be resolved in the courts of Rotterdam.
